2. Services Offered

Pingo Notify is a WhatsApp integration platform that enables:

1. Sending messages (text, image, audio, video, documents and stickers – according to the contracted plan).
2. Integration with WordPress, n8n and other systems through plugins and webhooks.
3. Creation of automated messaging flows and customer journeys.
4. Management of multiple connections/devices in a single dashboard.
5. Optional service for activation of the Official WhatsApp Business API and request for the Verified Badge.

3. Registration and User Account

1. The user must provide truthful and up-to-date information at the time of registration.
2. The account is personal and non-transferable. The user is responsible for keeping their access credentials confidential.
3. The use of the account for illegal, fraudulent purposes or in disagreement with these terms may result in immediate suspension or deletion.

4. Plans, Credits and Payments

1. Pingo Notify offers plans, each with specific limits and features as described on our website.
2. Message sending is accounted according to the contracted plan.
3. Credits are reset monthly and do not accumulate for subsequent periods.
4. Plan changes (upgrade/downgrade) can be made at any time, but credits already used are not refunded.
5. Payments are processed on a recurring basis, monthly or annually, according to the selection at the time of purchase.

5. Acceptable Use of the Platform

It is prohibited to use Pingo Notify to:

1. Send spam, chain messages, unsolicited bulk messages or content that violates applicable law.
2. Disseminate illegal, offensive, discriminatory, abusive content or content that infringes third-party rights.
3. Manipulate or attempt to access restricted areas of the platform in an improper way.
4. Compromise the security and stability of the service.

6. Official API and Unofficial API

The user may choose to use the Official WhatsApp Business API or an unofficial API; each option has its own characteristics and responsibilities.

1. The user may opt to use the Official WhatsApp Business API, with support for advanced features and greater stability.
2. If opting for the unofficial API, the user acknowledges that limitations or instabilities may occur, and Pingo Notify is not responsible for failures resulting from that choice.

7. User Responsibilities

1. The user is solely responsible for the content of the messages sent through the platform.
2. Pingo Notify is not responsible for damages, losses or disputes arising from misuse of the tool.
3. It is the user's duty to ensure use in compliance with LGPD, WhatsApp policies and applicable laws.

8. Limitation of Liability

1. Pingo Notify does not guarantee uninterrupted availability of the service; maintenance, updates or external failures may occur (especially related to unofficial APIs).
2. Under no circumstances shall Pingo Notify be liable for indirect losses, lost profits or damages resulting from unavailability or misuse of the platform.

9. Support and Customer Service

Support is provided through official channels published on the site and on the platform dashboard. Paid plans may have dedicated and priority support as described in the subscription.

10. Changes to the Terms

Pingo Notify may modify these Terms of Use at any time by publishing them on its website. Continued use of the platform after changes implies acceptance of the new terms.

11. Cancellation and Account Termination

1. The user may close their account at any time without penalty.
2. Pingo Notify reserves the right to suspend or cancel accounts in case of violation of these Terms, illegal use or harmful conduct.

12. Jurisdiction and Applicable Law

The contracting parties elect the court of the District of Curitiba, capital of the State of Paraná, to resolve any and all questions arising from this agreement, waiving any other jurisdictions. By agreeing, the parties accept this digital instrument in full.
